BRADENTON, FL (WFLA) - The Florida Department of Health says it served licensed massage therapist Kevin Joseph Holmes, 60, with an emergency order Tuesday morning that bans him from working with female clients.

The order says Holmes "unrestricted practice as a massage therapist with female clients constitutes an immediate serious danger to the health, safety, or welfare of the public."

The order will remain in effect until the agency completes an ongoing investigation and decides whether suspension of Holmes' massage license or discipline is warranted.

That regulatory action follows Holmes criminal arrest March 20th on a misdemeanor battery charge after a female client complained he had fondled her breasts during a massage March 16th inside his business known as Muscle Eze, located at 2620 Manatee Ave. W. in Bradenton.

Police say Holmes admitted reaching under the sheets to fondle the woman, later apologized to her and  told dectectives what he did was "absolutely inappropriate."

The state DOH order to stop work with female clients came soon after Eight On Your Side started asking questions about why the state was allowing Holmes to stay in business following his arrest.

On Monday, Eight On Your Side contacted Pinellas Republican State Senator Jack Latvala who in turn called Florida's Surgeon General, Dr. John Armstrong, with questions about the Holmes case.

Armstrong told Latvala that he would sign an emergency order that day and he did.

But none of that deterred Holmes from showing up at his business at least twice Tuesday. Both times he declined comment.

One of his loyal female clients who said she was there for therapy and spoke out on his behalf.

"I think that's ridiculous," Jennifer Washington said about the fondling complaint against Holmes. "I've been with him for two years and he's never tried anything like that on me."

The client who complained happens to be an off-duty law enforcement officer who has asked not to be identified.

"The thing that really scares me is the fact he knew I was a cop and still could not control himself," she told Eight On Your Side. "That is very disturbing."
