TAMPA, FL (WFLA) -

Julie Schenecker's defense team wants her statements to police thrown out of her murder trial.

Schenecker is accused of killing her 16-year-old daughter Calyx, and her 13-year-old son Beau in January of 2011.

Documents just released in the case show that after police found her at her home, Schenecker told Tampa police she'd been drinking, is bipolar, and was on medication.

As a result of this, defense attorneys say she was not capable of consenting to police questioning.

After being read her Miranda rights, defense attorneys say she asked for an attorney, but police did not immediately respond.

During later questioning, Schenecker a police spokesperson told reporters she told detectives she killed her children because they were "mouthy."

The court documents reveal Schenecker also told police she stayed in bed for 8 weeks because of her depression.

Her defense lawyer say in their court filing that during her interview with police, she appeared incoherent and was mumbling, but detectives kept talking to her.

A spiral notebook found in the Schenecker home appears to be in Julie Schenecker's handwriting, and also appears to be an admission of guilt.

A pre-trial hearing is scheduled for Tuesday for attorneys and prosecutors to discuss these issues.
