Judge: Holmes Beach can't fine tree house owners

MANATEE COUNTY, FL (WFLA) -

A circuit judge has ordered that for the time being, the city of Holmes Beach cannot fine the owners of a controversial tree house.

News Channel 8 has been covering the story for the past year.

In April 2011, Richard Hazen was granted permission by a Holmes Beach city official to build a tree house on his property.

So Hazen and his wife Lynn Tran built a massive two story tree house that’s reminiscent of Swiss Family Robinson.

Then, a dispute began with the city.

City officials say the tree house violates numerous building codes and must be either moved or dismantled. In September 2013, the Code Enforcement board decided to fine the owners $100 a day.

Hazen and Tran have been fighting the city in circuit court. On Monday, a circuit judge decided that while the appeals process is going on, the city cannot issue the daily fines.

Owner Lynn Tran told News Channel 8 that she is relieved.
