Medical marijuana debate heads to Florida's Supreme Court

ST PETERSBURG, FL -

The battle over medical marijuana heads to the Florida Supreme Court this week.

Thursday's hearing isn't about whether the state should legalize marijuana for medical use. It's about how the proposed amendment should be worded if it's added to the November 2014 ballot.

St. Petersburg based Save Our Society from Drugs is one of several non-partisan groups to file a legal brief against the proposed amendment.

"It's very misleading. It's duping the public," said Save Our Society from Drugs Executive Director Calvina Fay. "It allows pretty much anyone to use marijuana under the guise of medicine. It gives immunity for civil liability, immunity for criminal liability."

Attorney John Morgan is leading the grassroots effort to support the amendment. He calls the ballot language a straight forward attempt to let voters decide is marijuana should be allowed for medical purposes.

"This is a matter of compassion and mercy," Morgan told News Channel 8. "This is for people who have really, really bad injuries, really, really bad diseases and many are terminal."

The big issues at Thursday's hearing: is the ballot language accurate and does it only discuss a single subject?

Each side will have a half-hour to present its case, Fay said. Justices could take several weeks or months to rule.

Supporters need to collect a total of 700,000 verified voter signatures by February to get an amendment on the ballot.
