HILLSBOROUGH COUNTY, FL (WFLA) -  State Attorney Mark Ober's office has dropped murder charges against Tavari Grant.

Grant was one of two men charged with the murder of 16-year-old Kiara Brito and her 13-year-old brother, Jeremi.

On October 15, a jury found defendant Charles Waits guilty on two counts of First Degree Murder and two counts of Robbery with a Firearm.

A trial for Grant was scheduled to begin on October 28.

Now the State Attorney's office says, " The State of Florida has determined that there is insufficient evidence at this time to proceed to trial against Tavari Grant."

The Tampa Police Department issued a statement that says, "After some recent developments in the case, the Tampa Police Department met with the State Attorney and agreed that the murder charges should be dropped for  now. Detectives are still actively investigating possible accomplices including Tavari Grant."

The Tampa Police says that Grant was convicted of an armed bank robbery in 2012 and he is currently serving a seven year prison sentence for that crime.

Attorney Anthony Rickman works for the law firm that represented Charles Waits.

Rickman says he was not surprised by the State Attorney's action.

Rickman says, "It wasn't totally unexpected and the reason is the evidence against Tavari Grant is weak at best."

The State Attorney's office issued a statement that ends, "The investigation in this case as to any accomplices of Charles Waits remains open. Therefore, there will be no further comment at this time."
