State investigates NBRC Construction’s business practices

State investigators with the Department of Financial Services say they are investigating the business practices of NBRC Construction in Tampa.

The investigators say that since December they have received 90 complaints from insurance companies and consumers.

DFS Captain Michael Byrne said those complaints focus on the company's repeated practice of collecting money from storm damage insurance claims they've filed on behalf of homeowners and the failure to replace the roofs or pay contractors and material suppliers with the insurance money in dozens of cases.

An Eight On Your Side news investigation reveals that two of NBRC's top managers, Henry Martin Pureber and Carlton DeWayne Dunko, are currently out on bond after their arrest on theft charges two years ago in Georgia for similar business practices. 

"No comment," both men said when questioned Friday by News Channel Eight about their Georgia arrests.

Back then, Pureber and Dunko ran a company called American Shingle. Georgia prosecutors haven't yet decided whether to formally charge them, but the Better Business Bureau thought the American Shingle problem was serious enough to send out a nationwide alert following hundreds of complaints from customers in eleven states.

"It sounds very familiar," said NBRC Construction customer Greg Larson. "It's the exact same thing that's happening to us."

Dunko and Pureber have repeatedly declined interviews to answer questions about their business practices through their attorney. They ran away when News Channel Eight approached them for comment outside of their attorney's office Friday.

An Eight On Your Side investigation has identified dozens of homeowners who believe they have been victimized by NBRC's business practices. In some cases NBRC hired contractors to replace their roofs but didn't pay them with insurance proceeds NBRC received as direct payments from insurance companies. Now those contractors and suppliers are filing liens against the homeowners to recover payment for their goods and services.

In other cases, NBRC received insurance payments but no work was done. That's what Robert and Sara Fava say happened to them. Their home has been covered by a blue tarp for months and leaks have caused interior damage.

"We've called them a good 30, 40, 50 times through the last nine months of dealing with this," said Robert Fava."It stinks."

Fava and his wife Sarah say they have mostly been dealing with a customer service representative named Alex, or Chazz--he uses both names.

News Channel Eight discovered that Chazz's legal name is Charles Royall and he is currently serving a four year probation term after his conviction for theft, forgery and fraud. Royall also served time in prison for burglary and trafficking in stolen property and has a number of other past convictions including one for selling heroin.

"I'm dumbfounded," said Sarah Fava after learning about Royall's criminal history.

As recently as Wednesday, Royall assured her husband Robert the delay in getting a new roof is temporary.

"It is being taken care of," Royall said."The owners are doing everything they can to rectify this."

Royall also said nothing illegal had gone on at NBRC or American Shingle and told Fava The News Channel Eight report on NBRC "Is very inaccurate."
On the other hand, Royall told Fava, "I was as blown away by that news story...I was floored by it just as much as you are."

Charles Royall, also known as DJ Chazz, told us he's done nothing wrong in his role with NBRC Construction and declined further comment.
