Prosecutors still debate to try Dale Larkin for 2nd degree murder after appeals

Dale Larkin was in a courtroom this morning, as prosecutors continue to debate whether or not to try Larkin on second-degree murder charges.

An appeals court previously reversed Larkin's first-degree murder conviction in the 2003 death of his wife in Johnson City.

The appeals court ruled Larkin could be tried again, but only on the charge of second-degree murder.

The question now is whether prosecutors can use the findings of the expert witness in that original case.

A decision could come as soon as Larkin's next court date on December 16th.
