Lakeland fire inspector resigns in connection with sex scandal

Lakeland fire inspector David Bivens is off the job after resigning in connection with an on-going sex scandal investigation. City officials say Bivens was set to have a pre-disciplinary hearing this morning and would have been terminated if he hadn't quit first.

Bivens, 48, is the only Lakeland Fire Department employee named in a sex scandal that involves mostly Lakeland Police officers and a civilian police department crime analyst named Sue Eberle.

According to an investigation by State Attorney Jerry Hill, Bivens and Eberle had a sexual relationship that dates back to 2004. In the report Bivens admitted to having sex with Eberle on and off duty. 

"The statements that he made that he admitted to... that sealed the deal for me," said Fire Department Chief Gary Ballard at an afternoon press conference.

Ballard says the most upsetting revelation involves Bivens' admission that he and Eberle had sex outside a reception following the 2012 funeral for Lakeland Police Officer Arnulfo Crispin who was gunned down in the line of duty.

"When I read about what happened at Officer Crispin's funeral I'm disgusted with that," Ballard said.

Lakeland City Manager says the internal review of the sex scandal continues and now includes an additional six city employees who are not sworn or civilian police department workers.

"Any other city employee that doesn't fall into those two categories will be investigated by two different investigators that I've assigned from the Human Resources department that are reporting to my office," Thomas said.

The city manager hopes to have an announcement about that part of the investigation by the end of next week.
