Changes to St. Pete's red light camera program

ST PETERSBURG -

The City of St. Petersburg released information Friday regarding changes in state law regarding red light cameras, also known as the Mark Wandall Traffic Safety Act.

These changes in the law require the city to make the following changes to the "Stop on Red" program, that will take effect July 1.

Some of the changes include:

Right on Red Violations: Prohibits issuance of a violation if the driver of the vehicle came to a complete stop before turning right, if permissible at a red light, but failed to stop before crossing over the stop bar or other point at which stopping is required.

Notice of Violation: A person who receives a notice of violation may request a hearing within 60 days of the notification date or pay $158 fine (previously 30 days, and no hearing on the violation notice was permitted). Payment of a fee may not be required before the hearing. The notice of violation must be accompanied by information on the person's right to request a hearing and on all court costs that may be associated with the local hearing request (or direct the person to a Web site containing that information). If an affidavit is submitted by the owner of the motor vehicle identifying another as the driver of the vehicle at the time of the violation, a notice of violation may be reissued to the driver within 30 days after receipt of the affidavit.

Previously, the law allowed for transfer of the violation, but only at the higher fine amount.

Uniform Traffic Citation: A person shall be issued a uniform traffic citation if they have not made payment or requested a hearing to challenge a notice of violation within 60 days of the mailing of the notice of violation.

With these new amendments the program has addressed the concerns of the County Clerk of Court Ken Burke. The moratorium the city imposed on March 7 on issuing Uniform Traffic Citations to those who swear in an affidavit that they were not driving the vehicle at the time of the infraction, will be lifted.
