JACKSON, Tenn. (AP) - Jackson police said they are dismissing charges against a 24-year-old man in the shooting of a child and instead charging his brother with attempted murder.

Police said in a news release Friday they are dropping charges against Antonio "Tony" Demont Byrd in the Monday night shooting that injured a 1-year-old boy, who was struck in the head.

The news release said investigators interviewed additional witnesses who identified Byrd's brother, 22-year-old Justin O'Neal Byrd, as the shooter. Witnesses told police that Tony Byrd was not present when the shooting occurred.

Police said Justin Byrd and his girlfriend had identified Tony Byrd as the shooter but recanted their statements. Police said the shot was fired from a red Fiat in which Justin Byrd was a passenger during an argument over a burglary that Justin Byrd was allegedly involved in. Justin Byrd has been in custody on unrelated parole violation charges.
